CENTRAL ISLIP, NY — The NYPD officer charged in his son’s death and the boy’s mother were both in court on Thursday.
Justyna Zubko-Valva asked for permanent custody of her surviving sons, who are both back in school and doing well, according to Child Protective Services. CPS and a judge want to set up a mental and sexual abuse evaluation for the boys, but their mother is concerned. She feels the agency failed 8-year-old Thomas Valva, who froze to death in dad Michael Valva’s garage, and were criminally negligent in his death.
The judge pleaded with Zubko-Valva to allow her children to be examined. He said it’s a new day. She agreed to allow CPS to examine her children, despite concerns that the agency will retaliate against her for exposing flaws in the system.
In Michael Valva’s hearing, he said he can’t afford an attorney and has no access to funds. He wants legal aid.
His fiancee, Angela Pollina, 42, has also been charged. Her three daughters, who are not Valva’s children, are now in the custody of their fathers. The girls are also being monitored by Child Protective Services. The girls meet several times a week to play together.
