Sanford Rubenstein accused of raping woman after Al Sharpton’s birthday party

NEW YORK (PIX11) —The lawyer representing the woman attorney Sanford Rubenstein is accused of raping says he's confident Rubenstein will be indicted.

Attorney Keith White said there's a lot of new evidence he claims "will be devastating" to the high-powered attorney, who continues to maintain his innocence.

White offered no hint as to what the "devastating" new evidence is, but police were seen carting off a mattress from Rubenstein's posh upper Eastside apartment, along with a dozen or so evidence bags, including on with the label "biological evidence."

Rubenstein has admitted having consensual sex with the 42-year-old woman, a mother and business executive who holds a high-powered position in Rev. Al Sharpton's National Action Network.

The encounter occurred after Sharpton's 60th birthday bash at the Four Seasons.

Video purportedly confirms the woman "was out of it," and that the alleged rape was committed while she was in a drunken stupor. If that's the case, Rubenstein could face a charge of third degree rape, meaning the victim was incapable of giving consent.

Rubenstein has made a career representing New Yorkers who said they were victims of police brutality. The 70-year-old currently represents the family of Eric Garner, who died after he was put in a police chokehold in July.
