Judge orders stop to NY parks’ outdoor smoking ban

MANHATTAN (PIX11) — A New York judge has ruled that the state’s ban on outdoor smoking in parks oversteps authority, according to the Associated Press.

State Supreme Court Justice George Ceresia stated ban, which bars smoking at all New York City parks and several state parks and beaches, must be halted.

The judge sided with smokers’ rights group, saying the state Office of Parks, Recreation and Historic Preservation’s ban isn’t supported by any legislation.

New York City’s separate outdoor smoking ban is not challenged in the ruling.
