Baby dies after father forgets him in hot car in Hempstead

(PIX11) – A Hempstead man was arrested for homicide charges after his infant son died when he forgot him in a hot car for a half hour Tuesday.

Nassau County police say Devon A. Fenner, 25, called 911 at about 1:40 p.m. saying he forgot to take his seven-month-old son Dominick out of the car when he parked it at his residence on Millburn Avenue and that the child was not breathing.

When emergency technicians and police arrived, they found the baby unconscious and unresponsive in the 2003 Toyota.

The child was rushed to Mercy Medical Center in Rockville Centre where he was pronounced dead a short time later.

Fenner was arrested  shortly after and charged with criminally negligent homicide.

While Fenner did leave the window slightly open, the criminal complaint says the temperature in the car at the time was 119 degrees.

“Unfortunately, cracking the window on a 90-degree day doesn’t do much,” Kenneth Lack, a Nassau police spokesman said.

He said the baby most likely died of heat exposure but a pending autopsy will determine the cause of death.

He pleaded not guilty to the charges in First District Court in Hempstead Wednesday and had bail set at $50, 000 bond, or $25,000 cash.

Fenner could face up to four years in prison if convicted and is due back in court on August 28.

Lack also said Nassau’s social services agency is also looking into circumstances involving Fenner’s surviving children, an 8-year-old who doesn’t live with him and a 7-year-old son who does.

According to his defense attorney, Fenner was working for a moving and storage company and his previous arrests were nonviolent offenses, including marijuana possession.

    Probably flirting on his cell phone and forgot. I can't imagine there not being any distraction like that and him just walking away. Either way he's a jackass..
