(PIX11) – Tuesday, the mother of a National Guardsman killed by an NYPD detective announced plans to file a federal lawsuit against the city and the man who shot him.

22-year-old Noel Polanco was shot during a traffic stop on the Grand Central Parkway last year.

Detective Hassan Hamdy shot Polanco because he says he saw him reach under the seat with both hands.

Polanco was unarmed.

A grand jury chose not to indict the detective.
