EXCLUSIVE: Video shows cop pulling gun on ATV rider in Bronx park

WAKEFIELD, Bronx — The NYPD stripped a cop of his badge and gun as the Internal Affairs Bureau investigates an incident caught on video of an officer assigned to the 47 Precinct pointing what appears to be a gun at an ATV rider in a Bronx Park, police said.

The video captured on the Bronx man’s helmet cam, shows the officer, assigned to the 47 Precinct, yelling at the man to pull over at gunpoint.

“I heard a noise. I looked to my right it was a cop car and he was like pointing his gun at me,” said ATV owner Pete, who asked PIX11 to conceal his identity for fear of retaliation.

“My heart was pounding, I seen the gun pointed at me I was like 'oh [expletive]'.”

He says the cop said not to move but he took off because he was scared.

“I didn’t do anything violent to have a gun pointed at me. So I just tried to get away as quick as I can," he said.

According to the NYPD’s firearms and tactics guide, "because drawing the firearm is so provocative and alarming, it should be done only under circumstances in which officers reasonably believe that they may soon have to use deadly force to defend themselves or others against lethal assault."

“It looks like he has his finger on the trigger, so that is entirely in my opinion unacceptable,” said Kyce Siddiqi, a lawyer and former NYPD officer assigned to the office of the deputy commissioner for trials.

The so-called “trial room” is where allegations against officers are handled.

“There could be some issues with this officer that IAB is possibly investigating, IAB generally has jurisdiction when an officer is actually committing a crime. They would have jurisdiction, so there could be certainly more than IAB involving this. The NYPD office of Inspector General could be eyeing this as well,” Siddiqi said.

A police source said no criminal charges have been filed against the ATV’s owner.
