Chalena Moody, 25, and her biological father, Eric Lee Gates, 49, had a consensual relationship, the Register Guard reports. Gates was reportedly not involved in Moody’s life as a child. The two reconnected when she was an adult and began their illegal relationship.

Moody and Gates were living as a couple and had two children when detectives found out about their  affair. The couple had a third child together, but it died in utero, prosecutors say. The children reportedly have numerous medical problems and are in the custody of the state.

Moody was sentenced to 10 days behind bars, but was credited with time served. She also received 18 months probation, and cannot have any contact with Gates.

In Oregon, incest is a Class C felony, which can carry a jail sentence of up to 5 years.

Gates is currently in jail, serving a 60 day sentence for violating his probation and moving in with Moody. He has also been ordered to pay back the state of Oregon for medical expenses for the children.
