Tragedy at Hofstra: Student shot and killed during home invasion

(PIX11) – In a shocking development, Nassau County Police said Saturday evening that the 21-year-old Hofstra University student who was gunned down in a home invasion was killed by police gunfire. She was fatally shot by accident in the head, police said.

Earlier Saturday, the suspect in the death of Andrea Rebello was identified as Dalton Smith,  30, who was on parole and has an extensive criminal record. He entered the home around 2:30 Friday  with a ski mask covering his face, armed with a gun. But his gun did not kill her during the home invasion — it was police gunfire.

Police said police fired as Smith was leaving the house after a 20-minute or so ordeal, holding Rebello in a headlock. Smith was holding his weapon to her head.

It was then that seven police bullets hit Smith, who also died, and one struck Rebello, who lived in Tarrytown and was staying in the off-campus rental home on California Avenue in Hempstead. Her twin sister and two other people were in the house at the time of the home invasion.
